General terms and conditions of business and delivery

All deliveries and sticker installations are carried out in accordance with the general terms and conditions of business and delivery listed below. After receipt of an order, the seller can withdraw from the contract within 10 days without giving reasons. Claims for compensation are excluded. Delivery dates specified by the buyer are not binding for the seller unless the seller has expressly confirmed in writing that the delivery date requested by the buyer is correct.

The execution of a delivery order placed by the seller does not constitute acceptance of a delivery date specified by the buyer. The conclusion of fixed-term transactions always requires the express written confirmation of the seller.

Prices

Unless otherwise agreed, prices are ex Prien.

Shipping

Shipping is always at the expense and risk of the purchaser. Unless otherwise agreed, shipping will be carried out by post, rail, express or freight forwarding at our discretion. Additional costs for express and urgent shipments are borne by the recipient.

Transport insurance

Only carried out at the express request of the customer and at his expense.

Delivery

The seller will ensure that the delivery is made on time. Force majeure, operational disruptions, disruptions and delays in delivery, in import processing as well as disruptions due to strikes and lockouts release him from the obligation to deliver. Claims for damages due to late delivery are excluded unless we are responsible for intent or gross negligence.

Liability

We do not accept any liability for the application or the specific type of use of any of the products we sell. Such liability cannot be derived from any information leaflet, instructions for use or correspondence issued by us or from any customer service advice provided by us. The customer is in no way released from the obligation to check our products to see whether they are suitable for the intended purpose.

Exclusion of liability

for paraglider, hang glider and balloon lettering. The company excludes all liability for damage (personal injury and property damage) that may arise from a possible change in flight behavior as a result of the lettering. The customer undertakes to have the airworthiness of the aircraft checked after the lettering.

Copyright

By placing the order, the customer has assured that he is entitled to the copyright or all rights of use covering the reproduction of templates supplied by him or copies commissioned. He shall indemnify GH Werbebeschriftungen Gerald Helbig against all claims and reimburse all costs that arise as a result of third parties asserting a copyright or an exclusive right of use against GH Werbebeschriftungen Gerald Helbig.

Complaints

These must be reported before use or further processing within 10 days of the goods arriving with precise details of the defect, otherwise the goods are deemed to have been accepted without complaint. In the event of a justified complaint of defects, the seller reserves the right to decide whether to reduce the price or take back the goods and provide a free replacement. In no event will the seller's liability exceed the cost of a replacement delivery equal to the purchase price of the defective goods. Liability excludes all injuries, losses or damages, regardless of whether they are directly, indirectly or otherwise attributable to the delivery or use of the product. The buyer must check before use whether the products are suitable for the intended purpose. The seller cannot guarantee suitability for certain purposes because he has no influence on the manufacture or use of the goods he supplies. Nor does he have any influence on the treatment of the finished products made with these goods. Returns can only be accepted after prior written agreement. The seller's obligation is limited exclusively to the services listed here. This obligation replaces all other statutory or other guarantees or assurances.

Payment

The first three deliveries are always made by prepayment only. Regular customers can be granted a payment term of 14 days. In the event of default, default interest of at least 2% above the Bundesbank discount rate will be charged. We request that payments be made only to our company. If the customer's ability to pay deteriorates, we are entitled to demand payment before the agreed payment date and/or to withhold outstanding deliveries or to withdraw from the contract. The contractual payment dates must be met even if complaints are made.

Ownership rights

We retain title to the goods delivered by us until the purchase price and all claims from the current business relationship have been paid in full. The buyer is not entitled to pledge the goods or to transfer them as security. Seizures by other creditors must be reported to us immediately. The buyer is only entitled to resell the goods in the normal course of business.

Contract changes

When the order is placed, our terms and conditions are deemed to have been accepted in full. Deviations from the above conditions and sales conditions specified by the customer require our express written confirmation to be valid.

Place of performance is Prien.

Place of jurisdiction

Always Rosenheim for both parties, provided the buyer is a registered merchant.

Severability clause

If one of the above conditions is completely or partially invalid, this does not result in the invalidity of the remaining provisions.
